Terms of Use, Disclaimer & Refund Policy

1. What this service is
We provide document templates and a generator for contractors: change orders, payment demands, notices and lien-waiver forms. We are not a law firm, we do not practice law, and nothing here is legal advice. Using this service does not create an attorney-client relationship.
2. You are responsible for your documents
- Construction law differs by state and changes. Deadlines (for example for preliminary notices, liens and stop payment notices), required forms, and delivery methods are strict. A document that is late or in the wrong form can lose your rights.
- Where this service shows a statutory lien-waiver form, the wording was copied from the statute cited next to it on the date shown. Statutes are amended. Some text was taken from a secondary mirror of the statute and is labeled as such. Confirm the current official text before relying on it.
- For states marked "generic" or "not verified", the form we provide is not a statutory form and may be unenforceable there.
- Notices, demands and change orders are general templates. They do not replace the notice, cure and claim procedures in your contract, and may be inconsistent with it. Interest, fees and penalties may be claimed only if your contract or the law allows them; the generator does not decide that for you.
- Signing a lien waiver can permanently give up payment rights. Never sign an unconditional waiver before you have been paid in cleared funds. Read the document you are signing.
- For anything involving significant money, a dispute, or a deadline, consult a licensed construction attorney in the state where the project is located.
3. No warranty
The service and all documents are provided "as is" and "as available", without warranties of any kind, express or implied, including accuracy, completeness, fitness for a particular purpose, enforceability, or non-infringement, to the extent permitted by law.
4. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim, and we are not liable for lost profits, lost lien or payment rights, or indirect, incidental or consequential damages. Some jurisdictions do not allow certain limits; in that case the limits apply only as far as the law allows. [ATTORNEY: confirm enforceability in your state.]
5. Purchases and access
- "Single" access unlocks one document type for 24 hours from purchase. "All documents" access unlocks every document type for 12 months from purchase. [Adjust to match the product you sell.]
- Access is tied to the browser where you complete checkout. Payment is processed by Stripe; we do not receive your card number.
- Documents you create are generated from the details you type. We do not store the contents of your documents on our servers. Our hosting provider and payment processor keep standard technical logs (such as IP address, request path and timestamps), and we keep only the records needed to operate, secure and support the service.
6. Refund policy
[Choose and have reviewed. Suggested draft:] Because documents are delivered immediately, purchases are generally final. If you were charged and could not access what you bought, or you were charged twice, email team@theyardlab.com within 14 days with your Stripe receipt and we will fix the problem or refund you. This does not limit any refund right you have under law.
7. Acceptable use
Do not use the service to prepare false, misleading or fraudulent documents, to claim amounts you are not owed, or to violate law. We may refuse service or revoke access for misuse.
8. Privacy
Form entries you type are kept in your own browser (local storage) so you can come back to them, and are sent to our server only to build the preview or document. Stripe handles payment data under its own privacy policy. [ATTORNEY: add a full privacy policy if required where you operate.]
9. Changes and governing law
We may update these terms; the date above shows the latest version. These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. [ATTORNEY: venue/arbitration clause, if any.]
